Salati - who claims Jackson's 'black' bodyguard attacked him at a New York nightclub has been given the go-ahead to sue the chart star for $120 million. Jackson's legal representatives argued Jackson's only bodyguard that night was white. But Manhattan Supreme Court Justice Rolando Acosta ruled that bodyguard Joey Maldonado appears to be Latino, adding: "Latinos come in all shades." Salati had said the men who roughed him up were African-American - and one of them was 300 pounds. Lawyers say the bodyguard was 5-foot-8 and 180 pounds, and submitted a copy of his driver's licence to back up their claim.
